Public comments:
Brian Rogers addressed the City Council and explained that he wanted to apologize to the City and Council regarding a meeting he attended about a month ago where he addressed the City and Council about a water issue he was experiencing. Mr. Rogers said that after the Water Department checked the situation out, they determined that Mr. Rogers was on a well. He explained that the situation has been corrected.
Presentations:
Cody Mann, employee working in the Water/Wastewater Department, was selected as the Employee of the Month for August. Alderman Marcus Amthor and Jesse Hunt, Water/Wastewater Department Supervisor, presented Cody with a plaque with his name on it and a gift certificate to a local restaurant.
Consent Agenda:
The City Council unanimously approved the following: minutes from the July 26, 2022, council meeting; payment of bills; Resolution No. 2022-26, a Resolution to waive an Ordinance defining noise nuisances for Melissa Lopez August 27, 2022, at Mill Pond Park Gazebo; Resolution No. 2022-27, a Resolution to waive an Ordinance defining noise nuisances for Shawn Clancey September 3, 2022, at Mill Pond Gazebo; Resolution No. 2022-28 a Resolution to waive an Ordinance defining noise nuisances for Sarah Saldivar September 10, 2022, at Risien Park Pavilion; Resolution No. 2022-29 a Resolution to waive an Ordinance defining noise nuisances for St. Mary's Catholic Church September 7, 2022, at Risien Park.
The first action item
was to Discuss and Consider approving Ordinance No. 2022-04, an Ordinance of the City of San Saba, Texas, regarding a Zoning Change to the City of San Saba’s zoning ordinance in regard to property currently zoned One-Family Residential (R-2) to Commercial-Local and Through Highway Business (C-2) for property located at 265 Kelly Lane, 0.625 Acres of land out of O. Wilcox Survey 38, Abstract 1396, part of Block 9 of the old undeveloped portion of the old MurrayAddition to theTown of San Saba, for the purpose of Constructing a Restaurant for Rodney Norris.
George Amthor addressed the Council and explained that his niece was the person who sold the property for them. He also explained that the property at one time was all one tract of property. His dad was the owner of the whole tract of land before it was divided, and the property was on Hwy. 16 South. Mr. Amthor said he was told that anything that faced Hwy. 16 was considered commercial.
Kathy McEwin also addressed the Council and said she was told the same thing; it was commercial property.
Brandy Amthor, realtor and niece of GeorgeAmthor and Kathy McEwin, addressed the Council and said that it was her fault; she was under the understanding the property was Zoned commercial as well.
Greg Pannell also addressed the City Council and stated he wasn't going to say anything, but he was going to put his two cents in, explaining when he bought the property, he checked it out and the property was zoned residential. He also addressed the parking issue, and City Secretary Sabrina Maultsby explained that the City's Attorney said we could issue a 'No Parking' Permit for Mr. Pannell's property.
Alderman Marcus Amthor made a motion to approve Ordinance No. 2022-04, seconded by Alderman Shawn Oliver and was approved by a 3 to 1 vote.
was to Discuss and consider approving Ordinance No. 2022-06, an Ordinance of the City of San Saba, Texas, regarding the purchase and closing of a 20’x117.50’ portion of 2ndAvenue located between Block 1, Lot 3 and Block 2, Lot 1 in the Lindley Addition currently zoned Commercial-Local and Through Highway Business District (C-2) petitioned by Glynn Meador.
Janet Hoyt explained that Hoyt Real Estate was representing Mr. Meador, and they have a buyer for the property Mr. Meador owns. SecondAvenue is an unopened undeveloped street, and Mr. Meador owns the property on each side of 2ndAvenue. Closing this street will not affect anyone, and the potential buyer is requesting this be done.
Alderman Shawn Oliver made a motion to approve Ordinance No. 2022-06, seconded by Alderman
The third action item was to Discuss and consider approving Ordinance No. 2022-07, an Ordinance of the City of San Saba, Texas, regarding a Variance to the 25’Set Back Building line to 15’for property located at 507 W. Pecan, San Saba, Texas, Legal description, Block 1, Lots 13 and 14 in the Campbell and Lidstone Addition, currently zoned One-Family Residential District (R-2) requested by Reagan Burnham.
City Manager Scott Edmonson explained that the Mr. Burnham is requesting the setback to build a house on the property, and it will be in line with the other homes located on the street. He also explained there are some large trees located at the back of the property, and if he must build according to the City's setback requirement of 25', he will have to remove the large trees.
Alderman Oleta Behrens made a motion to approve Ordinance No. 2022-07, seconded by Alderman Marcus Amthor and was approved by a 4 to 0 vote.
The fourth action item was to Discuss, Consider and Approve the Economic Development Budget for FY 2022-2023, approved by the Economic Development Corporation at the meeting held on 08/02/2022.
City manager Scott Edmonson explained that the budget has been approved by the Economic Development Commission, and that they are bringing it to the City Council for approval. Alderman Shawn Oliver made a motion to approve the Economic Development Budget for the FY2022-2023, seconded by Alderman Oleta Behrens and was approved by a 4 to 0 vote.
The fifth action item was to Discuss, consider, and approve Ordinance No. 2022-08, an Ordinance of the City of San Saba, Texas, Amending Chapter 4 of the San Saba City Code of Ordinances to add Article 4.07, Mobile Food Vendors, Providing Definitions, and Regulations to Operate Mobile Food Units; Providing for a Severability Clause; Providing for a Penalty; Providing for a Savings Clause; Providing for Repeal for Conflicting Provisions and Providing for Publication and an Effective Date.
City Manager Scott Edmonson addressed the City Council and explained that the City has been working on this for quite some time. The Attorney prepared the Ordinance, Planning and Zoning made some changes and it is now being presented to Council for approval.
Alderman Shawn Oliver made a motion to approve Ordinance No. 2022-08, seconded by Alderman Marcus Amthor and was approved by a 4 to 0 vote.
The sixth action item was to Award contract for American Rescue Plan Funding, Water Line Improvements to Atlas Construction Corporation of Granite Shoals, Texas, submitting the low base bid of $278,724.70 also, submitted low alternate bids #1 and #2.
City Manager Edmonson explained that the funds from the American Rescue Plan will be expended to replace additional infrastructure water lines and bids were opened on July 28th here in the Council Chambers, and Atlas Construction submitted the low bid of $278,724.70 and submitted low alternate bids #1 and #2.
Luke checked the references for Atlas Construction, received positive responses, and recommends the City award the Base Bid and alternate bids #1 and #2 to them.
Alderman Oleta Behrens made a motion to approve to Award contract for American Rescue Plan Funding,Water Line Improvements to Atlas Construction Corporation of Granite Shoals, Texas, seconded byAlderman Shawn Oliver and was approved by 4 to 0 vote. City Manager’s Report:
City Manager Scott Edmonson reported on the following activities in the City of San Saba:
• Hines Paving will start the Parking lot striping and Hot Mix on the night of this meeting.
• Some adjustments were made by moving two handicapped parking spaces by the sidewalk and two by the Winery and Mercantile.
• The City Manager and Chief Bauer attended Commissioners Court to discuss budget issues.
• Denver and the City Manager have been discussing replacement of the utility poles and electrical lines in the future on Woodlawn.
• The San Saba Youth Association recently obtained a survey from Mr. Amthor, and the City Attorney has been working on an agreement.
• Opened the one-way street on Cherokee and recently installed a new stop sign where the previous one had been installed.
• City Manager spoke with the company where we buy the street paving material regarding the first three blocks of Commerce, and they are still saying nothing is wrong; Scott Glaze got new prices on aggregate.
